Terms of Service

These Terms of Service govern your access to and use of Tovuno POS, including our point-of-sale, business management and related services.

Business platform

Tovuno provides software tools for managing sales, stock, payments, employees, reporting and other business operations.

Subscription service

Certain Tovuno functionality may require an active trial or paid subscription according to the plan selected by the business.

Responsible access

Business owners control authorised users and are responsible for managing permissions, credentials and activity within their account.

Using Tovuno

Please read these Terms carefully. By creating an account, starting a trial, purchasing a subscription or otherwise using Tovuno, you agree to comply with these Terms.

1. Agreement to These Terms

These Terms form an agreement governing your use of Tovuno POS and related services provided under the Tovuno brand.

If you create or use an account on behalf of a company or other organisation, you represent that you are authorised to act on behalf of that organisation in relation to the Tovuno account.

2. Tovuno Services

Tovuno provides digital tools intended to assist businesses with point-of-sale and operational management. Depending on your subscription, features may include sales, inventory, customers, suppliers, employees, expenses, payments, accounting, reports, branches and integrations.

Features may be introduced, modified, improved or discontinued as the platform develops, subject to applicable obligations.

3. Business Accounts

You must provide accurate information when creating and maintaining a Tovuno business account. You are responsible for keeping business and contact information reasonably current.

The business account owner or authorised administrator is responsible for managing account access, branches, employees, roles and permissions.

4. Employees and Authorised Users

Businesses may create or authorise employee accounts such as administrators, managers, cashiers, accountants or inventory personnel.

Authorised users may access the same Tovuno business platform, but their available modules and actions may be restricted according to their assigned role and permissions.

The business is responsible for removing or restricting access when an employee or other authorised user should no longer access the account.

5. Free Trial

Eligible new businesses may be offered a seven-day free trial of Tovuno. Trial eligibility, available functionality and trial duration may be subject to reasonable platform rules intended to prevent abuse.

Unless otherwise stated during registration, starting a free trial does not itself require payment. Continued access to subscription-only functionality after the trial may require selection and payment of an applicable plan.

6. Subscriptions and Billing

Paid Tovuno services are provided according to the subscription plan, billing period and price displayed when the subscription is selected.

Subscription features, usage allowances and pricing may differ between plans. Any applicable taxes, fees or other charges should be shown where required.

If a subscription expires or payment is not completed, access to certain functionality may be restricted while business data is handled according to applicable retention policies and legal requirements.

7. Acceptable Use

You must not use Tovuno to:

  • Conduct unlawful or fraudulent activity.
  • Gain unauthorised access to another account or system.
  • Introduce malicious software or intentionally interfere with the platform.
  • Attempt to bypass security, authentication, permissions or access controls.
  • Misuse the service in a manner that materially affects other users or platform availability.
  • Use another person's credentials without appropriate authorisation.

Accounts involved in suspected abuse, fraud or serious security violations may be restricted while the matter is investigated.

8. Business Data

You retain responsibility for business information submitted to Tovuno. You grant us the permissions reasonably necessary to host, process, transmit, back up and otherwise handle that information for the purpose of providing and securing the service.

You are responsible for ensuring that information entered into Tovuno is collected and used lawfully and that employees or other users only access information they are authorised to access.

9. Payments and Integrations

Tovuno may support integrations with payment providers and other external services, including services used for mobile payments, tax compliance, communications or infrastructure.

Third-party services may be governed by separate agreements, fees, availability requirements and policies established by their respective providers.

Businesses are responsible for correctly configuring their own payment credentials, account identifiers and integration settings where applicable.

10. Service Availability

We work to keep Tovuno reliable and available, but uninterrupted or error-free operation cannot be guaranteed. Availability may occasionally be affected by maintenance, upgrades, internet connectivity, third-party services or circumstances outside our reasonable control.

11. Suspension and Termination

You may stop using Tovuno subject to any applicable subscription or account conditions. We may suspend or restrict access where reasonably necessary because of security threats, unlawful activity, serious misuse, unpaid subscription charges or material violations of these Terms.

Where appropriate and legally permissible, reasonable steps may be taken to provide notice or an opportunity to resolve an account issue.

12. Limitation of Liability

Tovuno is a business software tool. Businesses remain responsible for their operational decisions, accounting, taxation, inventory controls, employee management and compliance obligations.

To the extent permitted by applicable law, liability arising from the use or inability to use Tovuno will be subject to applicable legal limitations and any specific contractual commitments agreed with the customer.

13. Responsibility for Your Use

You are responsible for activities carried out through your business account by users you authorise and for maintaining appropriate internal controls over account access, sales, payments, refunds, inventory and other business operations.

14. Applicable Law

These Terms are intended to operate subject to applicable laws and regulatory requirements in Kenya. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.

15. Changes to These Terms

We may update these Terms as Tovuno develops or when legal, regulatory or operational requirements change. Material updates may be communicated through the platform, website or account contact information where appropriate.

The current version will be made available on this page with its latest update date.
